This policy describes how Fifth Nine LLC ("we," "us," or "our") handles information on fifthnine.com and inquiries sent through the website. Data handling for a client engagement is addressed in the applicable service agreement.

Information You Send Us

Our contact form requires your first name, last name, email address, and message. You may also provide a phone number, company name, service interest, and how you heard about Fifth Nine. The form sends these details through Postmark as an email to Fifth Nine so we can read and respond to your inquiry.

If you email us directly, we receive your email address and whatever information you include. Please avoid sending sensitive personal information or confidential client data in an initial inquiry.

The website has no newsletter signup or subscription mailing list.

Preparing and Sharing an Intake Brief

The /start/ form collects your name, email address, and the brief you paste or the answers you write. We send these to Matt by email through Postmark to review your inquiry and prepare for a conversation. We may process briefs and answers internally with AI tools, including Anthropic's Claude, as part of our intake flow. Please review the text before sending it and remove personal details about customers or employees, passwords, contract terms, and exact non-public financials.

If you use the prompt in your own AI assistant, that provider handles the conversation under your account's terms and settings. The assistant links include the full prompt shown on /start/ in their URL. They do not include form entries. Fifth Nine receives your brief only when you send the form or email it to us.

Booking a Call or Session

We use a self-hosted Cal.com calendar at cal.fifthnine.com to schedule calls and team-session planning calls. It collects your name, email address, chosen time, and answers about your company and the work you want help with. We use that information to arrange and prepare for your call or session. To prepare, we may process your booking answers with AI tools, including Anthropic's Claude. Booking links and the embedded calendar pass a page-source value through the “How did you hear about Fifth Nine?” field.

The calendar may use cookies or browser storage for scheduling. You can open it directly if the embedded calendar does not load. Please do not include confidential client data in booking answers.

Lead Log and Source Attribution

We keep a lead log in Cloudflare D1 for contact submissions, call bookings, and session requests. It contains the time, type of inquiry, follow-up email, company and headcount when provided, booking identifier, and source attribution, including the “How did you hear about Fifth Nine?” answer. Contact messages and other booking answers are not copied into this log.

A first-party cookie called fn_first_touch remembers the page where you first arrived and the referring website’s hostname for 30 days. It contains no unique visitor identifier and does not store URL query strings. We pass this source to our calendar and attach it to your inquiry to understand which pages bring people to Fifth Nine. If you block cookies, you can still contact us and book a call.

Intake submissions also create a contact-type row in this log, with an identifier beginning with start:, the time, follow-up email, and first-touch source when available. Your name, brief, and written answers are not stored in D1.

Website Hosting and Analytics

Cloudflare hosts the website and handles requests to it, including contact form requests. Serving those requests involves processing technical information such as your IP address, the requested URL, and browser request headers. The contact endpoint also logs processing errors.

We use Cloudflare Web Analytics to understand website traffic and performance. It reports page views, referrers, browser and device information, country-level location, and page performance timings. It is cookieless and does not track individual visitors across websites.

We use page views of /start/ to measure interest in intake, and page views of the contact thank-you page as an indication of contact and intake form activity. The analytics beacon does not send the contents of either form.

Cookies and Browser Signals

Our application sets the first-touch attribution cookie described above. Cloudflare Web Analytics does not set cookies. Cloudflare may use cookies when providing security features; its cookie documentation describes those features.

The website has no cookie preference controls and does not implement handling for Global Privacy Control (GPC) or Do Not Track (DNT) signals. You can control cookies through your browser settings.

Retention and Security

Contact inquiries and intake briefs are handled as email correspondence. The D1 lead log and booking records do not have an automatic deletion schedule; you can request their deletion using the contact below. The website does not run an automatic deletion schedule for these messages. Retention of correspondence and provider-held records depends on the systems in which they are stored; there is no single website-wide retention period.

The website uses HTTPS to encrypt information in transit. No method of transmission or storage is completely secure.

Privacy Requests

To ask about information you have sent us, or to request access, correction, or deletion, email hello@fifthnine.com. The rights available to you and any required response deadlines depend on applicable law. A request may require information to confirm your identity and identify the relevant correspondence.

Updates are posted on this page with a revised "Last updated" date.
